Welcome to GivLuv! GivLuv is an online marketplace where individuals and businesses can sell goods, list ads, and optionally donate a percentage of the sale to charities. By using our platform, you agree to these Terms & Conditions.

1. Definitions

• GivLuv / Platform / We / Us / Our: The online marketplace operated by GivLuv.
• User / You: Anyone accessing or using the platform, including buyers and sellers.
• Listing / Advertisement: An item or service posted for sale on the Platform.
• Charity: Any nonprofit organization eligible to receive donations through GivLuv.

2. Eligibility & Account Registration

• Users must be at least 18 years old.
• Both individuals and businesses may create accounts and list items.
• Account registration requires a valid email address and other relevant information.
• You are responsible for keeping your account details secure and for all activity under your account.

3. Listings & Content Rules

• You may only post items you legally own and are allowed to sell.
• Listings must include accurate descriptions and images.
• GivLuv reserves the right to remove listings that violate our policies or applicable law.
• GivLuv does not guarantee the quality, authenticity, or condition of any listed item.

4. Payments & Donations

• Payments are processed exclusively through Stripe.
• Users can choose a percentage of the sale to donate to a charity.
• Donations are split automatically at the time of sale: part goes directly to the charity, and the remainder to the seller.
• GivLuv does not hold any funds; we are not responsible for payment disputes.

5. Charities

• Participating charities may change over time.
• Users can select the charity they wish to support at the time of sale.
• GivLuv ensures that donation transfers comply with applicable laws.

6. No Quality Guarantee / Limitation of Liability

• GivLuv acts only as a platform to list and facilitate transactions.
• We do not guarantee item quality, condition, authenticity, or legality.
• Users are solely responsible for their transactions, including delivery and payment.
• GivLuv is not liable for damages, losses, or disputes between buyers and sellers.

7. User Responsibilities

• Communicate respectfully and truthfully with other users.
• Complete transactions fairly, including delivery, payment, and donation commitments.
• Report any fraudulent or illegal activity to GivLuv immediately.

8. Shipping, Returns & Communication

• Shipping, delivery, and returns are fully managed by the buyer and seller.
• GivLuv does not provide shipping services and is not responsible for lost, damaged, or delayed items.
• Users are encouraged to use tracking and insurance as needed.

9. Fees

• GivLuv charges a fee for posting listings.
• Fee details are displayed before confirming the listing.
• All applicable taxes are the responsibility of the seller.

10. Prohibited Items

You may not list or sell items that are:

• Illegal or prohibited by law
• Counterfeit or infringing intellectual property rights
• Hazardous or unsafe items

GivLuv may remove prohibited listings at any time.

11. Privacy & Data

GivLuv collects personal data including name, email, contact info, listing details, payment info, and IP/device data.

Data is processed according to our Privacy Policy, available separately.

By using GivLuv, you consent to the collection and processing of data as described in our Privacy Policy.

12. Suspension & Termination

• GivLuv may suspend or terminate accounts that violate these Terms, applicable law, or are involved in fraudulent activity.
• Users may delete their account at any time.

13. Changes to Terms

• GivLuv may update these Terms at any time.
• Material changes will be notified via email or on the Platform.
• Continued use of the Platform constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Netherlands.

Any disputes arising from use of GivLuv will be resolved in Dutch courts.
